CREDIT:  To establish credit, a confidential credit application can be obtained from Leonard Melton Nursery. This credit application should be completed and returned at least six weeks prior to date of shipment. Customer will be advised of credit status prior
to shipment.
     All past due accounts will be charged a 1½% per month service charge. (this is an annual rate of (18 percent). In the event that the entire unpaid balance of this bill becomes due and payable, the buyer agrees to pay all expenses of collection, including reasonable attorney's fees and court costs.
     These terms shall be interrupted in accordance with the laws of the State of Tennessee and courts of Warren County, Tennessee shall have exclusive jurisdiction over any disputes arising from any transaction.

PRICES: This is a wholesale price list based on present market conditions and prices are subject to change without notice. All prices are F.O.B. McMinnville, TN.

CLAIMS: Any claim must be filed in writing within (10) days of receiving shipment. Failure of buyer to give notice of any claim with respect to any material delivered within (10) days after the receipt of such materials will not be recognized by the seller. 
                We shall in no case be liable for any sum greater than the amount originally received for said nursery stock.
                Absolutely no claims for non- viable material after June 1.

LIABILITY: All stock is guaranteed true to name and in good healthy condition, but we assume no responsibility after it leaves the NURSERY. We give no warranty expressed or implied, as to description, productiveness, or any other matter of any nursery stock we sell. It is mutually agreed that out liability for any errors or other causes is confined to free replacement or refund or original purchase price.
            All orders are accepted subject to prior sales of stock and crop conditions. Orders shall be void should injury befall our stock from frost, hail, error in count, or other causes beyond our control. ALL orders are accepted without liability for non-performance if labor shortages or delay in transportation should prevent us from making delivery.

SHIPPING: We have contacts with independent truckers who will deliver your stock on mileage basis at a reasonable price. In absence of specific details, we ship the best and most economical way, but without assuming responsibility. Customers are responsible for unloading truck and paying freight and shipping charges.
